📢 Important Legal Update｜Work Eligibility & APRC Rules for Overseas Chinese Students
The Ministry of Education has announced that the Executive Yuan amended the Act for the Recruitment and Employment of Foreign Professionals on September 24.
•Article 4(4)(4), Article 28, and Article 29 will take effect on June 30, 2026 (115/6/30).
•All other articles will take effect on January 1, 2025.

Below is a summary of the key changes relevant to overseas Chinese students 👇

✅ 1. Easier for New Graduates to Work in Taiwan (Article 12)
Foreign students (including overseas Chinese students) who obtain an associate degree or above in Taiwan:
During the period of extended residence approved by the National Immigration Agency as a new graduate,
👉 you may work in Taiwan without applying for a work permit.

✅ 2. APRC Residency Requirements Can Be Reduced (Article 18, Paragraph 4)
If you obtain a degree from a Taiwanese college or university, you may deduct years from the required residency period for an APRC:
🔹 Foreign Professionals
•Doctorate: 3 years deducted
•Master’s: 2 years deducted
•Bachelor’s / Associate degree: 1 year deducted
(Deductions cannot be combined across different degrees)
🔹 Foreign Special Professionals
•Doctorate: 2 years deducted
•Master’s: 1 year deducted
(No combination allowed)

教育部通知：行政院已於 9/24 修正公布「外國專業人才延攬及僱用法」。
第4條第4款第4目後段、第28條及第29條，定自明(115)年6月30日施行；其餘條文，定自明年1月1日施行。

✅ 1. 應屆畢業生留台工作更方便（第12條）
取得我國 副學士以上學位 的外國學生（含僑生）：
在畢業後、以「應屆畢業生」身分向移民署申請延期居留期間，
👉 可以在台工作不用申請工作許可。

✅ 2. 永久居留（APRC）可折抵居留年數（第18條第4項）
在台取得大專校院以上學位者，可依學歷折抵永久居留所需年限：
🔹 外國專業人才
•博士：折抵 3 年
•碩士：折抵 2 年
•學士/副學士：折抵 1 年
（※不同學歷之折抵 不可合併）
🔹 外國「特定」專業人才
•博士：折抵 2 年
•碩士：折抵 1 年
（※不可合併）
